Terms of Service

Please read these terms carefully. They govern your use of the CafePop platform and form a binding legal agreement between you and CafePop Switzerland GmbH.

By using CafePop you agree to be at least 18, to provide truthful information, to treat other users with respect, and to use the Platform only for lawful purposes. We can suspend your account if you violate these terms. Your data is handled under Swiss law and we never sell it. All disputes are governed by Swiss law in Zürich courts. We may update these terms with reasonable notice.

Acceptance of Terms

Welcome to CafePop. By accessing or using the CafePop website, mobile application, or any related services (collectively, the "Platform"), you confirm that you have read, understood, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

These Terms constitute a legally binding agreement between you and CafePop Switzerland GmbH ("CafePop," "we," "us," or "our"), a company incorporated under Swiss law. If you do not agree to these Terms, you must not access or use the Platform.

By creating an account, subscribing, or simply browsing the Platform, you are entering into a binding legal contract. Please read these Terms carefully before proceeding.

Your continued use of the Platform following the posting of revised Terms means you accept and agree to the changes. It is your responsibility to review these Terms periodically.

Eligibility

To access or use CafePop, you must meet all of the following eligibility requirements. By using the Platform, you represent and warrant that:

  • You are at least 18 years of age. CafePop is strictly an adult platform. We do not permit access to or use by anyone under 18 years old.
  • You have the legal capacity to enter into a binding contract under the laws of your jurisdiction.
  • You are not prohibited by any applicable law from accessing or using the Platform.
  • You are not located in a jurisdiction where access to adult content or discovery platforms is legally prohibited.
  • You will use the Platform only for lawful purposes and in compliance with these Terms.
  • All information you provide during registration is accurate, truthful, and complete.

CafePop reserves the right to verify your age and identity at any time. Providing false information about your age or identity is a serious violation of these Terms and may result in immediate account termination and potential legal action.

CafePop may, at its sole discretion, refuse to offer the Platform to any person or entity and may change eligibility criteria at any time.

Account Registration

Creating Your Account

To access most features of the Platform, you must register for an account. When creating an account, you agree to provide accurate, current, and complete information and to update this information to keep it accurate, current, and complete.

  • You must provide a valid email address that you own and control.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must notify us immediately of any unauthorised use of your account.
  • You may not share, transfer, or allow others to access your account.
  • You may only maintain one active account at a time.

Account Verification

CafePop employs a manual verification process for profiles to ensure quality and authenticity on the Platform. Profile activation is subject to review and approval by our moderation team. We reserve the right to reject any profile that does not meet our content and quality standards.

Verified status (the "Verified" badge) is granted solely at CafePop's discretion following our internal review process. Verification does not constitute an endorsement of any individual.

Account Security

You are solely responsible for maintaining the security of your account. CafePop will never ask you for your password. If you suspect your account has been compromised, you must change your password immediately and contact our support team.

Platform Description

CafePop is a premium, privacy-first discovery platform operating in Switzerland. The Platform enables independent adult women ("Profile Members") to create curated personal profiles, and enables other registered users ("Visitors") to browse, save, and connect with Profile Members.

Core Features

  • Profile creation with photos, personal information, interests, and contact details.
  • Browsing and discovery of verified profiles in Swiss cities.
  • Swipe-based profile interaction — save or pass on profiles.
  • Direct connection via WhatsApp upon saving a profile (contact number shared only after save action).
  • Subscription-based access for Profile Members to activate and manage their profiles.
  • Manual moderation and verification of all profiles before public visibility.

CafePop does not operate in-app messaging. All communication between users occurs externally, directly via WhatsApp or other means chosen by the parties. CafePop is not a party to, and bears no responsibility for, any communications or arrangements made between users outside the Platform.

Platform Limitations

CafePop provides a technology platform only. We are not an agency, we do not broker meetings, and we do not arrange appointments. The Platform is a discovery and connection tool. What users do with their connections outside of CafePop is entirely their own responsibility.

Profiles & Content

Your Content

You retain ownership of all content you submit to the Platform ("User Content"), including profile photos, bio text, interests, and other information. By submitting User Content, you grant CafePop a non-exclusive, worldwide, royalty-free, sublicensable licence to use, display, reproduce, and distribute your User Content solely for the purposes of operating and providing the Platform.

Content Standards

All User Content must comply with the following standards:

  • Content must be accurate and truthful — you may not misrepresent your identity, age, location, or any personal characteristics.
  • Profile photos must be authentic photographs of yourself. AI-generated images, stock photos, or images of other people are strictly prohibited.
  • Content must not be sexually explicit. Suggestive content must comply with our separate Content Policy available on the Platform.
  • Content must not infringe any third-party intellectual property rights, including copyright, trademark, or right of publicity.
  • Content must not contain personal contact information beyond what the Platform explicitly permits (e.g., embedding phone numbers in profile photos is prohibited).
  • Content must not promote or advertise third-party platforms, services, or businesses.
  • Content must not be defamatory, harassing, discriminatory, or otherwise unlawful.

Content Moderation

CafePop reviews all profiles and content manually before publication. We reserve the right to reject, remove, or modify any User Content that, in our sole discretion, violates these Terms, our Content Policy, or applicable law. Removal of content does not entitle you to a refund of any subscription fees paid.

You may report content that you believe violates these standards by contacting our moderation team at hellocafepop@gmail.com. We take all reports seriously and aim to respond within 24 hours.

Submitting false, misleading, or fraudulent profiles is a serious violation of these Terms and Swiss law. CafePop cooperates fully with law enforcement authorities in cases involving fraud, impersonation, or other criminal conduct.

Subscriptions & Payments

Subscription Plans

Activating and maintaining a profile on CafePop as a Profile Member requires a paid subscription. Current subscription plans, pricing, and features are available on our Pricing page. CafePop reserves the right to modify pricing at any time with reasonable advance notice to affected subscribers.

Billing & Payment

  • All subscription fees are quoted and charged in Swiss Francs (CHF).
  • Payment is due at the beginning of each subscription period.
  • We accept major credit and debit cards and other payment methods listed on the checkout page.
  • By providing payment information, you authorise CafePop (or its payment processor) to charge your payment method for the applicable subscription fees.
  • Subscriptions do not automatically renew unless you explicitly opt into an auto-renewal plan.
  • You are responsible for any applicable taxes, duties, or charges imposed by your local authority.

Cancellation & Refunds

You may cancel your subscription at any time through your account settings. Upon cancellation, your profile will remain active until the end of the current paid period, after which it will be deactivated. CafePop does not offer pro-rata refunds for unused portions of a subscription period except where required by applicable Swiss consumer law.

If your profile is removed or suspended by CafePop for violation of these Terms, no refund will be issued for any remaining subscription period.

Pausing Your Profile

Profile Members may pause their profile visibility at any time through account settings without cancelling their subscription. A paused profile is hidden from all users but all data and photos are retained, allowing you to reactivate instantly.

Free Features for Visitors

Visitors (users who browse profiles rather than create them) may access certain Platform features without a paid subscription, including browsing verified profiles and saving favourites. CafePop may introduce premium Visitor features or subscription tiers in the future.

Prohibited Conduct

You agree not to use the Platform in any way that is unlawful, harmful, deceptive, or otherwise contrary to these Terms. The following conduct is strictly prohibited:

Identity & Fraud

  • Creating a profile or account on behalf of another person without their explicit consent.
  • Impersonating any person, entity, or CafePop employee.
  • Providing false or misleading information in your profile or during registration.
  • Using the Platform to engage in any form of fraud, deception, or misrepresentation.
  • Creating multiple accounts to circumvent a suspension or ban.

Harmful & Unlawful Behaviour

  • Harassing, threatening, intimidating, or abusing other users in any way.
  • Soliciting, collecting, or harvesting personal information of other users without consent.
  • Using the Platform to facilitate, promote, or engage in any illegal activity under Swiss law or the law of your jurisdiction.
  • Attempting to coerce, manipulate, or pressure any other user into any arrangement.
  • Sharing or distributing any content obtained through the Platform without the explicit consent of the person depicted.

Technical Abuse

  • Attempting to access, probe, or test the vulnerability of the Platform or any related system.
  • Scraping, crawling, or otherwise extracting data from the Platform using automated means.
  • Reverse engineering, decompiling, or attempting to derive the source code of the Platform.
  • Introducing malware, viruses, or any other malicious code.
  • Interfering with or disrupting the integrity or performance of the Platform.
  • Using bots, scripts, or automated tools to interact with the Platform.

CafePop cooperates fully with Swiss law enforcement authorities and will disclose user information in response to lawful requests, including in cases involving fraud, harassment, or other criminal conduct.

Privacy & Data

Your privacy is fundamental to how CafePop operates. Our use of your personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection, use, and processing of your personal data as described in the Privacy Policy.

Key Privacy Principles

  • Your contact information (WhatsApp number) is only disclosed to users who explicitly save your profile — it is never publicly displayed.
  • CafePop does not engage in in-app messaging. All external communications are between you and other users directly.
  • We do not sell, rent, or trade your personal data to third parties for marketing purposes.
  • We do not display advertising on the Platform.
  • All data is processed in accordance with Swiss data protection law (nDSG) and the EU General Data Protection Regulation (GDPR) where applicable.
  • You have the right to access, correct, export, or delete your personal data at any time.

Data Retention

We retain your data for as long as your account is active or as necessary to provide you with the Platform. Upon account deletion, we will delete or anonymise your personal data within 30 days, except where retention is required by applicable law.

Swiss Jurisdiction

CafePop is operated from Zürich, Switzerland. All data processing is governed by Swiss law, including the revised Federal Act on Data Protection (revFADP / nDSG) which came into force on 1 September 2023.

Intellectual Property

CafePop's Intellectual Property

The Platform and all of its original content (excluding User Content), features, and functionality are and will remain the exclusive property of CafePop Switzerland GmbH and its licensors. This includes, without limitation, the CafePop name, logo, design, software, text, graphics, user interface, and the arrangement and selection thereof.

CafePop's intellectual property is protected by Swiss and international copyright, trademark, and other intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the Platform or CafePop's intellectual property beyond the limited licence to use the Platform as described herein.

Your Licence to Use the Platform

Subject to your compliance with these Terms, CafePop grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform for its intended personal purposes. This licence does not include the right to:

  • Reproduce, modify, or distribute any content from the Platform.
  • Create derivative works based on the Platform or its content.
  • Use any data mining, scraping, or similar automated data gathering or extraction methods.
  • Download (other than page caching) any portion of the Platform.
  • Use the Platform for any commercial purpose without CafePop's prior written consent.

Copyright Complaints

If you believe that your copyrighted work has been reproduced on the Platform in a way that constitutes copyright infringement, please notify us at hellocafepop@gmail.com with full details of the claimed infringement.

Disclaimers

THE PLATFORM IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

No Warranties

To the fullest extent permitted by applicable Swiss law, CafePop expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including without limitation:

  • Any implied warranty of merchantability, fitness for a particular purpose, or non-infringement.
  • Any warranty that the Platform will be uninterrupted, error-free, or secure.
  • Any warranty regarding the accuracy, reliability, or completeness of any content on the Platform.
  • Any warranty regarding the identity, character, or intentions of other users of the Platform.
  • Any warranty that defects or errors will be corrected.

User Interactions

CafePop does not verify the accuracy of information provided by users beyond our standard moderation process. You are solely responsible for your interactions with other users. CafePop is not responsible for the conduct, whether online or offline, of any user of the Platform.

Meeting people from online platforms carries inherent risks. Always exercise personal judgement and appropriate precautions when meeting anyone you have connected with through CafePop. CafePop is not liable for any harm arising from your offline interactions with other users.

Third-Party Services

The Platform may reference or link to third-party websites and services, including WhatsApp. CafePop is not responsible for the availability, content, or privacy practices of any third-party service. Use of third-party services is governed by their respective terms and policies.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE SWISS LAW, CAFEPOP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, revenue, data, goodwill, or business opportunities.
  • Damages arising from your use of or inability to use the Platform.
  • Damages arising from unauthorised access to or alteration of your transmissions or data.
  • Damages arising from conduct or content of any third party on the Platform.
  • Damages arising from your offline interactions with other users.

In no event shall CafePop's total aggregate liability to you for all claims arising out of or relating to these Terms or your use of the Platform exceed the amount you paid to CafePop in the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow the exclusion or limitation of certain types of damages. If you are in such a jurisdiction, some or all of the above limitations may not apply to you.

Termination

Termination by You

You may close your account and terminate these Terms at any time by accessing your account settings and selecting "Delete Account," or by contacting us at hellocafepop@gmail.com. Upon deletion, your profile will be deactivated and your personal data will be deleted in accordance with our Privacy Policy and applicable law.

Termination by CafePop

CafePop reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, including without limitation for:

  • Any violation of these Terms or our Content Policy.
  • Fraudulent, deceptive, or illegal activity.
  • Behaviour harmful to other users or the Platform community.
  • Non-payment of subscription fees.
  • A requirement of law enforcement or applicable regulation.
  • Extended inactivity (we will provide reasonable notice before closing inactive accounts).

Effect of Termination

Upon termination, your right to access and use the Platform ceases immediately. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

Termination for cause does not entitle you to any refund of subscription fees paid. Termination not for cause may, at CafePop's discretion, result in a pro-rata refund for the unused portion of any prepaid subscription period.

Governing Law

Swiss Law

These Terms and any dispute arising out of or relating to these Terms or your use of the Platform shall be governed by and construed in accordance with the laws of Switzerland, without regard to its conflict of law provisions.

Jurisdiction

Any dispute, controversy, or claim arising out of or in relation to these Terms, including their conclusion, breach, termination, or invalidity, shall be subject to the exclusive jurisdiction of the competent courts of the Canton of Zürich, Switzerland, subject to any mandatory provisions of applicable consumer protection law that may confer jurisdiction on courts in your place of residence.

Dispute Resolution

Before initiating any formal legal proceedings, we encourage you to contact us at hellocafepop@gmail.com to attempt to resolve any dispute informally. We are committed to resolving disputes fairly and expeditiously. Most concerns can be addressed through our support team within 5 business days.

If you are a consumer resident in the European Union or the European Economic Area, you may also have rights under the mandatory consumer protection laws of your country of residence, which may differ from the laws described above.

Changes to Terms

CafePop reserves the right to revise and update these Terms at any time at our sole discretion. All changes are effective immediately upon posting and apply to all access to and use of the Platform thereafter.

We will provide you with reasonable advance notice of material changes to these Terms through one or more of the following methods:

  • An email notification to the address associated with your account.
  • A prominent notice on the Platform.
  • A notification through the CafePop mobile application.

Your continued use of the Platform following the posting of revised Terms means you accept and agree to the changes. The date at the top of the Terms indicates when they were last updated.

If you disagree with the revised Terms, you must stop using the Platform immediately and may terminate your account as described in Section 12.
